Why would I ban you for asking a question? That's silly. It was totally a judgement call on my part, and it was not the first time this happened. I also think Brett's post was more vitriolic/nasty than BillD's but again it's a judgement call like everything else. I do hope it's a wakeup call for Brett as he has been a valued poster in areas where he's not vitriolic/nasty.

Of course he can. That's the "tyrannical prerogative" reason, which I can only account for the continued lack of application as Lum having really amazing reserves of patience. Brett's a canker sore on the forum. In the grand scheme of things, his presence doesn't make the forum any less healthy, even repeated flareups don't endanger the forum's future health, they're not even that painful, but boy are they irritating.

The denial of a summary judgment motion simply means that the judge is willing to let the case go forward to determine what the conduct really was and how widespread it was and how it impacted the alleged victim. It means he's not prejudging the evidence. It means he hasn't decided anything, except that it COULD be worse than in other cases where no liability was found. I thought Theodotus oversold that by a fair bit but didn't see the point in debating him at the time.
